These general terms and conditions of sale (hereinafter “GTCS”) govern the sales made on the website photovag.art (hereinafter “the Website”), published by Olivier Ovaguimian under the commercial name Photovag.art (hereinafter “the Seller”). The Website offers two categories of products for sale: downloadable digital products related to landscape photography practice (guides, tools, practical sheets), and limited edition art prints from the Seller’s photographic work. Any order placed on the Website implies the unreserved acceptance by the customer (hereinafter “the Customer”) of these GTCS.

Article 2 — Purpose

The purpose of these GTCS is to define the rights and obligations of the parties in the context of the online sale of products offered by the Seller on the Website, whether digital products or physical art prints.

Article 3 — Products Offered

3.1 Digital Products

The Seller offers digital products downloadable immediately after payment, including:

  • The Photographer’s Tide Kit (interactive simulator and practical guide in PDF format);
  • The Finistère Field Card (field map in PDF format). These products are sold as digital files, without physical media, delivered via direct download or an access link sent by email.

3.2 Limited Edition Art Prints

The Seller offers physical art prints from his photographic series for sale (notably “Memory of Granite”, “The Fury and the Grace”, and “Atlantic Silences”), produced in black and white, square format. Each print is offered in a strictly limited edition of five (5) copies per image. Each copy is numbered and signed by the Seller’s hand. The edition number and the signature constitute inseparable authentication elements of the print; no additional reproduction of the image will be made beyond the announced limit of five copies, unless a different format or medium is explicitly offered as a distinct edition. The essential characteristics of each print (dimensions, medium, paper, finish, price) are specified on the corresponding product sheet before any order is placed. As the prints are artworks produced in a voluntarily restricted number, the Seller does not guarantee the continuous availability of any given item; once the five copies of an edition are sold, it will no longer be available for sale.

Article 4 — Prices

Prices of the products are indicated in euros (€), including all taxes where applicable. For information purposes only, an approximate conversion into US dollars (USD) may be displayed for buyers outside the euro zone; only the price in euros displayed at the time of the order is binding and constitutes the price actually invoiced. The Seller reserves the right to modify his prices at any time; products are invoiced based on the rates in effect at the time the order is validated. Shipping costs for physical prints, when applicable, are indicated separately before the final validation of the order.

Article 5 — Orders

Orders are placed directly on the Website, via the online sales module (WooCommerce). The Customer selects the desired product(s), checks the contents of their cart, and then validates their order after having read and accepted these GTCS. An order confirmation is sent by email to the Customer at the address provided during the order process.

Article 6 — Payment

Payment is made online at the time of ordering, by credit/debit card via the secure payment solution WooPayments. The Seller does not store or directly process the Customer’s banking data, as these are exclusively managed by the payment service provider.

Article 7 — Delivery and Access to Products

7.1 Digital Products

Access to digital products is provided immediately after payment validation, via direct download from the Website or by sending a download link to the Customer’s email address. No physical delivery timeframe applies to these products; the Customer is invited to verify the proper receipt of the link and to download their file as soon as possible.

7.2 Art Prints

Art prints are shipped to the postal address specified by the Customer during the order process, within an indicative timeframe of: Within 3 days after payment validation, except in cases of force majeure or exceptional unavailability. Packaging and transport methods are adapted to the fragile nature of photographic prints. The Seller will inform the Customer of any significant delay relative to the indicated timeframe.

Article 8 — Right of Withdrawal

8.1 Digital Products

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for digital content provided on a non-material medium if the performance has begun after the Customer’s prior express agreement and express waiver of their right of withdrawal. Consequently, the Customer expressly acknowledges and accepts, prior to any validation of an order for a digital product, that:

  • The performance of the contract begins as soon as the file is downloaded or the access link is sent;
  • They expressly waive their fourteen (14) day right of withdrawal once the download has been initiated;
  • No refund can be requested once the file has been downloaded or the access link has been transmitted.

8.2 Art Prints

For physical art prints, the Customer benefits from a fourteen (14) day right of withdrawal from the date of receipt of the product, in accordance with Articles L221-18 et seq. of the French Consumer Code, provided that the print does not constitute a personalized item within the meaning of Article L221-28 (1°) of the French Consumer Code. In the event that the right of withdrawal is exercised for an eligible print, the return shipping costs shall be borne by the Customer, and the print must be returned in its original packaging, in perfect condition.

Article 9 — Warranties

Digital products are provided “as is”. The Seller endeavors to ensure the accuracy of practical information (tide data, technical recommendations) but does not guarantee the total absence of errors and cannot be held liable for any inappropriate use of the tools provided. Art prints benefit from the legal warranty of conformity and the warranty against hidden defects, in accordance with applicable legal provisions.

Article 10 — Intellectual Property

All photographic works, texts, guides, and digital content offered on the Website remain the exclusive property of the Seller, protected by copyright. The purchase of a digital product grants the Customer a personal and non-commercial right to use the file; any reproduction, resale, public distribution, or modification is strictly prohibited without the prior written authorization of the Seller. The purchase of an art print grants the Customer ownership of the physical object, but does not transfer any reproduction rights to the image, which remain the exclusive property of the Seller.

Article 11 — Personal Data

Personal data collected during the order process (name, address, email) are processed in accordance with the General Data Protection Regulation (GDPR) and the Website’s privacy policy. This data is used exclusively for processing the order, delivery, and, subject to the Customer’s consent, sending the Seller’s newsletter. It is never transferred to third parties for commercial purposes.

Article 12 — Liability

The Seller cannot be held liable for non-performance of the contract in the event of force majeure, internet network disruption or unavailability, or the act of a third party beyond his control.

Article 13 — Applicable Law and Disputes

These GTCS are subject to French law. In the event of a dispute, the Customer is invited to contact the Seller as a priority at photovag.landscape@gmail.com in order to seek an amicable solution. Failing an amicable resolution, and in accordance with current regulations, the consumer Customer may refer the matter to a consumer mediator.
